These Terms of Service ("Terms") govern your use of the services provided by Local Boost HQ, a trading name of THEFOCUS LTD (Company Number: 14154101), registered at 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ ("Company", "we", "us", or "our").

1. Agreement to Terms

By purchasing a subscription, paying an onboarding fee, or using our services, you agree to be bound by these Terms. If you do not agree, you must not use our services. These Terms apply to both business and consumer customers. Nothing in these Terms affects your statutory rights under the Consumer Rights Act 2015 or any other applicable UK legislation.

2. Services Provided

Local Boost HQ provides digital marketing, web design, local SEO, and advertising management services ("Services") based on the subscription tier (Starter, Professional, or Growth) purchased by the client. All prices shown on our website are in GBP and inclusive of VAT at the prevailing rate (currently 20%).

3. Your Right to Cancel (Consumer Contracts Regulations 2013)

If you are a consumer (an individual acting outside of your trade, business, or profession), you have the right to cancel your subscription within 14 days of the date on which the contract is concluded, without giving any reason. This is your statutory cooling-off period under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

  • How to cancel: To exercise your right to cancel, you must inform us by a clear statement (e.g., by email to hello@localboosthq.com or by post to our registered address). You may use the phrase: "I wish to cancel my subscription within the 14-day cooling-off period."
  • Refund during cooling-off period: If you cancel within the 14-day period, we will reimburse all payments received from you. If you have requested that services begin during the cooling-off period, you will be charged a proportionate (pro-rata) amount for the services provided up to the point of cancellation.
  • Refund timing: We will process your refund without undue delay, and no later than 14 days after the day on which we are informed of your decision to cancel. We will use the same means of payment as you used for the initial transaction.

4. Subscriptions, Payments, and Cancellations

  • Billing: Services are billed on a monthly subscription basis through our payment processor, Stripe. Your first payment is taken at the point of purchase, and subsequent payments are taken on the same date each month.
  • No Lock-In Contracts: We do not enforce long-term binding contracts. You may cancel your monthly subscription at any time after the 14-day cooling-off period has passed.
  • Cancellation after cooling-off period: Upon cancellation, your service will remain active until the end of the current paid billing cycle. As services are delivered continuously throughout each billing period, refunds are not provided for partial months after the cooling-off period.

5. Intellectual Property and Your Content

Unless expressly stated otherwise, the websites, funnels, and logical frameworks built by Local Boost HQ remain the intellectual property of THEFOCUS LTD. During your active subscription, we grant you a non-exclusive, non-transferable licence to use the website and associated materials solely for your business purposes.

  • Our IP: All website designs, code, page layouts, conversion frameworks, and technical infrastructure created by Local Boost HQ are and remain the property of THEFOCUS LTD. This licence does not transfer ownership of any of these materials to you.
  • Your Content: Any text, images, logos, branding materials, or other content you provide to us ("Your Content") remain your property at all times. We do not claim ownership of Your Content and will only use it for the purpose of delivering our services to you.
  • Portfolio use: We may display anonymised or non-confidential examples of work completed for you (such as screenshots or case studies) in our portfolio, unless you notify us in writing that you do not wish us to do so.

Upon Termination

  • Licence revocation: When your subscription ends, the licence granted above terminates immediately. You may no longer use, copy, republish, or redistribute the website design, code, or frameworks built by Local Boost HQ.
  • Hosting and access: Hosting and public access to the website infrastructure we built will cease at the end of your final paid billing period.
  • Your Content retrieval: You may request a copy of Your Content (text, images, logos, and any data you supplied) within 30 days of termination by emailing hello@localboosthq.com. We will provide this in a commonly used electronic format (e.g. ZIP archive) at no additional charge.
  • After 30 days: Following the 30-day retrieval window, we may securely delete Your Content from our active systems. Any data retained beyond this point is held solely to meet our legal and accounting obligations as described in our Privacy Policy.

6. Advertising Budgets (Google Ads / Facebook Ads)

For clients on the Growth plan, management fees paid to Local Boost HQ do not include your actual ad spend paid directly to Google or Meta (Facebook). Ad spend is billed directly by the advertising platforms to your own payment method and is not included in the subscription price shown on our website.

7. Service Quality (Consumer Rights Act 2015)

Under the Consumer Rights Act 2015, our digital services must be provided with reasonable care and skill. If our services do not meet this standard, you have the right to request that we either re-perform the service or, if re-performance is not possible or not carried out within a reasonable time, you may be entitled to a price reduction. Nothing in these Terms limits or excludes your statutory rights.

8. Limitation of Liability

We do not guarantee specific rankings, traffic volumes, or lead volumes as these are dictated by third-party algorithms (e.g., Google, Meta). In no event shall THEFOCUS LTD be liable for any indirect, consequential, or special damages, including loss of profits, arising out of your use of our services. Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any matter for which it would be unlawful to exclude or restrict liability.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Both parties submit to the exclusive jurisdiction of the courts of England and Wales. If you are a consumer resident in Scotland or Northern Ireland, you may also bring proceedings in your local courts.
